In Greater Noida, stamp duty is now payable at the booking stage, not at possession. Once you’ve paid 10% of the flat cost, the builder has to execute a registered agreement to sell with you, and the stamp duty (6% to 7% of the property value, plus 1% registration) falls due at that point. At handover you sign a separate possession deed on Rs 100 stamp paper.

That single change moves roughly six to seven lakh rupees on a Rs 85 lakh flat from year four of your purchase to month one. Nothing else about the rate has changed. The timing has.

We deal with this every week at our sales desks in Noida and Greater Noida, and the same three questions come up: how much do I need on day one, what happens if the project stalls, and can I still sell before possession. Here’s the full picture.

What changed in Greater Noida, and when

The Greater Noida Authority approved the change at its board meeting in late October 2024, and it came into practical effect for new bookings from April 2025. It rests on Section 13 of the Real Estate (Regulation and Development) Act, 2016, which bars a developer from taking more than 10% of a unit’s cost without a registered agreement for sale.

Three things follow from it:

  1. The agreement to sell is registered, not notarised. The old habit of signing a builder-buyer agreement on Rs 100 stamp paper and filing it away is gone for new projects. The agreement now goes to the Sub-Registrar and carries full stamp duty.
  2. Stamp duty is collected up front. You pay it when the agreement is registered, on the value of the property as assessed then.
  3. A possession deed follows at handover. That document is executed on Rs 100 stamp paper, because the duty has already been paid.

Greater Noida wasn’t first. The Noida Authority brought in a comparable requirement in November 2024, and YEIDA has a parallel rule for its allottees. All of it traces back to the Uttar Pradesh government’s order of 9 September 2024 directing the authorities to enforce the 10% ceiling under RERA.

The reasoning is not hard to follow. Greater Noida has carried stalled group housing projects for more than a decade, with buyers who had paid most of the price and still had nothing registered in their name. An unregistered agreement is a weak instrument in a dispute. A registered one is evidence.

Stamp duty and registration charges in Greater Noida 2026

The rates themselves are set by the Uttar Pradesh government and are identical in Noida, Greater Noida and Greater Noida West. Only the timing is local.

On the women’s concession: the UP Cabinet approved a 1% stamp duty relief for women buyers on properties valued up to Rs 1 crore in July 2025, replacing the older benefit that was capped at Rs 10,000 on properties up to Rs 10 lakh. Maximum saving is now Rs 1 lakh. Above the Rs 1 crore mark, the concession does not apply and the standard rate is charged. Circulars on this have been read differently by different sub-registrars, so confirm the figure for your specific deed on IGRSUP before you pay.

Everything is calculated on the higher value

Stamp duty is never charged on the price you negotiated, by itself. It’s charged on whichever is higher: your transaction value, or the circle rate value of the property.

For most Greater Noida flats bought from a developer, the agreement value sits above the circle rate, so the agreement value binds. For resale deals and for plots in the older Greek-alphabet sectors, the circle rate is often the higher figure.

Worth knowing for 2026: the circle rate schedule that the Gautam Buddh Nagar administration published in March 2025, proposing increases of 20% to 70%, was never notified. The 2019 schedule is what the Sub-Registrar still applies. Reports through mid-2026 pointed to a fresh proposal of roughly 20% for Noida and up to 25% for Greater Noida and Noida West, but until a notification appears, it’s a proposal. What this costs you on a real flat

Take a 3 BHK in Greater Noida West with an agreement value of Rs 85 lakh, booked today.

Registering in a woman’s name saves Rs 85,000 on this deal. Buying jointly saves Rs 42,500. Those aren’t rounding errors, and the decision has to be made before the deed is drafted, not after.

Two costs sit outside that table. GST at 5% applies to under-construction homes and is paid to the developer with your instalments, not to the Sub-Registrar. And banks do not fund stamp duty. Your home loan is sanctioned against the property value; the duty comes out of your own pocket, alongside the down payment. What the rule means for you as a buyer

Your day-one cash requirement roughly doubles. Budgets built around “10% now, registry later” no longer work. Plan for the booking amount and the duty together.

Your title position is much stronger. A registered agreement to sell gives you a document the state has recorded. In a builder dispute, before RERA or in a civil court, that matters considerably more than a notarised paper. This is the real gain and it’s worth the cash-flow pain.

Selling before possession gets more expensive. If you transfer the unit after registering the agreement, the buyer pays duty afresh on their deed. The short-hold investor play, where units changed hands two or three times before completion with nothing registered, is exactly what the rule was designed to stop.

Cancellation is the open question. If you or the developer cancel, recovering stamp duty already paid means applying to the Stamp and Registration Department, and refunds there are slow and partial at best. Read the cancellation and refund clauses in the agreement before you sign, not after. If the language is vague about who bears the duty on cancellation, ask for it to be made specific.

Check the project’s dues. Some Greater Noida projects carry unpaid land dues to the Authority that hold up registration entirely. Ask for the no-dues position in writing and check the project’s status on UP RERA before you pay anything.

How to pay: the practical sequence

1. Get the valuation right. Pull the notified circle rate for the sector and property type, apply parking and amenity loadings separately, and compare it against the agreement value. Duty is charged on the higher figure.

2. Have the agreement drafted. It should carry the unit number, tower, carpet and built-up area, payment plan, possession date, penalty for delay, and the RERA registration number of the project.

3. Pay on IGRSUP. Register on the UP Stamp and Registration portal, select Gautam Buddh Nagar and the correct Sub-Registrar office (Greater Noida properties fall under SRO Sadar Greater Noida, not SRO Noida), generate the e-stamp, and pay by net banking, NEFT or RTGS.

4. Book the appointment. Both parties attend the Sub-Registrar’s office with two witnesses for biometrics and execution.

5. Collect and store the registered document. Then apply for mutation so the Authority’s records carry your name.

Budgeting the duty at 6% because a friend’s wife bought last year. The concession has a value ceiling, and joint ownership sits in between.

Assuming the circle rate went up because a newspaper said it would. A proposal is not a notification.

Signing an agreement with a vague possession date. “Approximately 42 months from commencement” is not a date you can enforce.

Paying more than 10% before the agreement is registered. That’s the specific thing the rule forbids, and a developer who asks for it is telling you something about how they operate.

Can I get my stamp duty back if the booking is cancelled?

There is a refund process through the Stamp and Registration Department, but it’s discretionary, slow, and rarely returns the full amount. Check what your agreement says about cancellation before you sign.

Is stamp duty different in Noida and Greater Noida?

The rates are the same, because both fall under Uttar Pradesh. The registration jurisdiction differs: Greater Noida properties go to SRO Sadar Greater Noida, Noida properties to SRO Noida.

Does a home loan cover stamp duty?

No. Lenders fund against the property value and exclude stamp duty and registration from the sanctioned amount. Budget for it separately.

How much do women save on stamp duty in UP?
